The B.C. Government has recently announced that March 31 to April 6, 2014 is “Make-a-Will Week” (http://www.ag.gov.bc.ca/make-a-will/) in B.C. in order to encourage the public to write their will or bring an existing out of date Will up to date. According to a 2010 report, over 50% of British Columbians do not have a signed, legally valid and up-to-date Will….. are you one of them?
If so, you may be wondering whether you need a Will. What does a Will do for you?
A Will is an important written document made during our lifetime which contains your instructions about how your affairs are to be handled on your death. A Will, among other things, appoints a person (aka the Executor) to assume control of your assets when you pass away and distribute in accordance with your instructions in your will, it sets out your wishes for who you would like your assets to go to and it appoints a guardian for minor children. If you do not have a Will in place, you do not get to choose who will be appointed by the court to act as your executor and your assets will be distributed in accordance with a prescribed framework set out in B.C.’s intestacy laws – which may not be what you want.
